Your Right To An Appeal
When an individual makes a criminal appeal, he or she is petitioning the higher court to review the decision of the lower court. During its review, the higher court (such as the Illinois Court of Appeals, Illinois Supreme Court or U.S. Circuit Court of Appeals), will determine whether an error was made by the lower court. These errors can include:
- Evidentiary ruling errors: exclusion of evidence that the jury should have heard or inclusion of evidence that the jury should not have heard (such as unfair and prejudicial evidence)
- Prosecution errors: intentional or unintentional misconduct by prosecutors
- Defense errors: ineffective assistance of counsel
If the higher court finds that the lower court erred, it can reverse the conviction, remand back to the lower courts for a new trial or resentence the conviction.
